Privacy policy
1. Who we are
"erny" is a brand owned and operated by Arclite ME General Trading LLC, a company licensed in Dubai, United Arab Emirates, with its registered address at Al Jahra Building - 403, Khalid Bin Al Waleed Rd, Al Raffa, Dubai, United Arab Emirates ("erny", "we", "us").
We are the controller of the personal data described in this policy. You can reach us about privacy at privacy@erny.ae.
2. What this policy covers
This policy explains how we handle personal data when you visit erny.ae (including www.erny.ae) or apply to join the erny pilot through our waitlist form.
It does not cover third-party websites or apps you reach through links on our site, such as Instagram, TikTok or WhatsApp. Their own privacy policies apply.
3. Information we collect

We do not ask for payment details, Emirates ID or other sensitive personal data on the waitlist.
4. How we use your information
- To review your application: we check whether erny suits your business and whether we can include you in the pilot. We score applications using the details you give and your public business profile. This helps us prioritise; a person makes the final decision on who joins.
- To contact you about the pilot: we send you WhatsApp messages about your application, onboarding and the pilot. You can reply STOP at any time.
- To run and improve our marketing: we measure which ads and page versions bring in suitable sellers, using aggregated results. Reports we produce internally contain lead IDs, not names or numbers.
- To keep the site secure: we use bot protection and rate limits to stop spam and abuse.
- To meet legal obligations: we keep records where UAE law requires it.
We use automated tools, including AI services, to help sort applications and draft messages. We do not sell your personal data.
5. Legal basis
We process your personal data in line with the UAE Personal Data Protection Law (Federal Decree-Law No. 45 of 2021) and other applicable laws.
- Consent: you tick a box agreeing to this policy before submitting the waitlist form, and you choose whether to accept analytics and advertising cookies. You can withdraw consent at any time (section 9). Withdrawing does not affect processing that already happened.
- Steps you asked us to take: reviewing your application and contacting you about the pilot you applied for.
- Legal obligations: where the law requires us to keep or disclose information.
6. Who we share it with
We share personal data only with service providers who help us run the site and the pilot, under contracts that limit their use of it, or when the law requires it.

We may also disclose data to authorities when required by law, or to a buyer or successor if our business is sold or reorganised.
7. International transfers
Your personal data is stored and processed outside the UAE. Our waitlist database is hosted in Frankfurt, Germany, and some of our providers process data in the European Union, the United States and other countries.
We transfer data only to providers who offer appropriate safeguards, such as contractual data protection terms, in line with the UAE Personal Data Protection Law. By submitting the waitlist form you agree to these transfers.
8. How long we keep it

If you ask us to delete your data, we do so within 30 days, except for anything we must keep by law.
9. Your rights
Subject to applicable law, you can ask us to:
- give you a copy of the personal data we hold about you
- correct data that is wrong or incomplete
- delete your data
- stop or restrict how we use it, including for marketing messages
- object to decisions made solely by automated processing
- withdraw your consent at any time
To use any of these rights, email privacy@erny.ae from the contact details you gave us, or reply STOP to our WhatsApp messages to stop marketing messages. We may ask you to confirm your identity. We respond within 30 days.
If you are not satisfied with our response, you can complain to the UAE Data Office.
10. Cookies and tracking
When you first visit, a banner asks whether you accept analytics and advertising cookies. Nothing in the analytics or advertising groups below loads until you accept.

You can change your choice at any time with the "Cookie settings" link in the site footer or the button below, or by clearing cookies in your browser.
11. Security
We protect your data with encryption in transit (HTTPS), a database that cannot be read from the public website, access limited to the people and systems that need it, and bot protection on our form. Our internal reports and logs use lead IDs instead of names or phone numbers.
No system is completely secure. If a breach affects your personal data, we will notify you and the relevant authority as the law requires.
12. Children
The erny pilot is for businesses and sellers aged 18 or over. We do not knowingly collect data from anyone under 18. If you believe a minor has applied, email privacy@erny.ae and we will delete their data.
13. Changes to this policy
We may update this policy as the pilot develops or the law changes. We will post the new version on this page with a new "Last updated" date. If a change is significant, we will tell you by WhatsApp or email before it takes effect.
